Getting the Legal Ball Rolling

If you decide to sue someone for injuries that he or she caused you due to negligence or liability, your attorney will generally begin by filing a complaint and issuing a summons. The complaint sets forth the grounds of the lawsuit and states the injury or damage suffered by the plaintiff, as well as the names of the person(s) believed to be responsible and the type of remedy that the court is being asked to impose. A legal notice issued by the clerk of the court (a summons) informs the person named as a defendant that legal action has been initiated against him or her. It also directs the defendant to file an answer with the court by a specified date.

HINT: Failure to respond to a summons usually results in a default judgment being entered against the defendant.
