Dave: Do you prefer the winter? Somewhere in between?
Ed: Less humid.
Greg Fellerman: He was complaining about how cold it was like a month ago.
Ed: The humidity is terrible.
Dave: I think we’ll get you some days here soon. All right, here’s our question here tonight. And let’s talk to Kristen in Mountain Top who says, “I was driving down our main street in town and a car made a left turn in front of me and I crashed into the car. I was injured.” Kristen wants to know who might be at fault.
Ed: Kristen, the person that turned in front of you is the car at fault for this. In Pennsylvania, you have to yield the right of way to somebody who is proceeding along the road that has the right of way and there’s not an intersection, there’s not a stop sign, there’s not a light you’ve indicated that you had to stop at and went through. That person who is going to be turning left you have the right of way and they must yield that right of way until it’s safe to proceed with that turn. That individual would be at fault but you are going to need to look into a lawyer quickly on this one.
Greg: Yeah, left turn cases are winners. They are the hardest for us if we try to disprove a left turn case, we lose. Any time there’s a left turn case, somebody cut you off, it’s a simple right of way analysis, you usually win those. Go to the doctor, give notice to your insurance company, do everything you need to do. Pictures, document, you’ll probably win. You deserve it! You didn’t do anything wrong. Good case.
