Denied Social Security Disability, Do You Need a Lawyer?

Dave Kuharchik: Social Security disability, that is the topic of today’s Law & You. Back with us attorneys Greg Fellerman and Ed Ciarimboli. Guys as always I love starting the week off
here on “The Law & You.”

Ed Ciarimboli: Did you have a good weekend?

Dave: I did, how about you guys?

Ed: Not bad, not bad at all.

Greg Fellerman: All good for me.

Dave: Alright, well all good here. So let’s get to the question and help someone else hopefully feel a little bit better. Susan in Wilkes-Barre wants to know, “I filed for Social Security disability and was just denied. Do I need a lawyer for the appeal?” I’m gonna answer this one for her because I’m pretty sure that the answer is yes.

Ed: And why does Susan need a lawyer?

Dave: Well, because these type of cases are complicated.

Ed: Absolutely and in the Social Security system it’s not unlike the court system it’s an adversarial process. You are going to be questioned, there’s a judge there. You need somebody that’s gonna be able to represent your rights in this particular case and handle it appropriately. You need a lawyer who can be able to cross-examine the doctors from social security; be able to cross-examine the vocational experts from social security. So don’t take these things lightly, this is absolutely an adversarial process and you need somebody that will be able to stand up for you.

Greg: Yeah, the denial kicks in. You have 60 days to appeal it, you should appeal it, hire a lawyer, get to the hearing and be ready to go because if and get your medical records everything needs to be submitted and if you have a lawyer helping you present that evidence to a judge it will go in a lot better. You get a much much better result and the probability of winning goes up.
