Do I Really Need an Attorney for My DUI?

A viewer was pulled over for drunk driving. His friends don’t think he needs an attorney but he’s having second thoughts. What do “The Law & You” lawyers think?

Dave Kuharchik: We’re talking DUI in this edition of “The Law & You.” A virtual law center here brings you attorneys Greg Fellerman and Ed Ciarimboli every night. It’s always a pleasure, guys.

Dave: All right, here’s our question tonight and we’ll get to it about DUI. “I was pulled over for a DUI,” says Norman in Scranton, “last weekend and my friends are telling me I don’t need an attorney. I kind of think I do. Can you help?”

Ed: Norman, your friends are idiots. You absolutely, unequivocally need an attorney. It’s a DUI. It is very, very, very serious. If you do not have a lawyer to walk you through this process — and when I say walk you through this process, I’m hoping this is the first time this has ever happened to you, and you’re eligible for ARD. But guess what? You’re not eligible for ARD unless you have an attorney to advocate on your behalf. So whatever friends are giving you advice, they’re bad friends. Pick up the phone and call a lawyer. Seriously.

Greg: The Constitution actually provides you a right to legal counsel. So use it. Don’t be foolish and walk into a courtroom by yourself without having an attorney who is skilled in that area. There are a lot of men and women who do a great job representing their clients in the criminal courts throughout Northeastern Pennsylvania on a daily basis. They’re reasonable. They’re worth every penny you’re going to spend on them. So pick up the phone and make that phone call. Do yourself a favor.

Ed: And obviously, none of them are your friends.

Greg: No, they’re too cheap.

Dave: Get some new friends.

Ed: Get some new friends, Norman!
