Do We Have a Claim Against Purdue Pharma?

Our only child died of opioid abuse. Do we have a claim against Purdue Pharma? He lived in upstate NY and died on January 1, 2017. We live in NEPA. Should we file a claim online or hire an attorney?

Haley Bianco: It’s that time of the day for The Law and You. Joining us today remotely we have Greg Fellerman and Ed Ciarimboli. Nice to see you guys hows it going over there?

Greg Fellerman: It’s great.

Ed Ciarimboli: Haley, we should start having a little virtual happy hour…

Haley: Yeah! Many people are doing that to maintain sane really. It’s a good idea. And today we’re getting free legal advice from you so let’s get to this viewer-submitted question. This one says, “Our only child died of opioid abuse. Do we have a claim against Purdue Pharma? He lived in Upstate NY and died on January 1, 2017. We live in NEPA. Should we file a claim online or hire an attorney?” What do you think?

Ed: Well, you know its a very good question. We’ve been on the frontlines of the opioid cases. Nationally we represent a number of counties, cities and municipalities, boroughs and townships. The cases have not yet gone to the point where individuals are going to have a direct claim against Purdue. But I do see that that is a possibility. They’re not there yet from a legal standpoint how these cases kind of work themselves through the system for the counties, cities, and municipalities. Counties first, but it’s certainly something that we would absolutely be willing to talk with you about but we just haven’t seen those cases start to move off there just yet.

Greg: I think there’s some issues with their recent bankruptcy filing. There’s some notices you have to give if you want to pursue a claim against Purdue, possibly in the bankruptcy setting so that’s evolving pretty quickly. So if you do have a question, one of your loved ones died in the opioid crisis, give us a call we can at least get you boned up on what you need to know. And help you if need be.
