I Was Diagnosed With Cancer But Was Never Sent to a Specialist. Do I Have a Case?

A viewer was recently diagnosed with cancer. Despite a nasty cough, his primary doctor never sent him to a specialist. Does he have a case of medical malpractice? Med mal attorneys Ed Ciarimboli and Molly Clark explain his legal options.

Dave Kuharchik: We got a question tonight about lung cancer. Back with us tonight, in for Greg once again, her name is Molly Clark. Attorney Ed Ciarimboli here is well. Good to see you again.

Ed Ciarimboli: We are ready to go. Let’s do this today.

Dave: All right, here’s our question involving lung cancer. Let’s see what we have to answer today. Bill from Lake Ariel says, “I was recently diagnosed with lung cancer. I had been seeing my family doctor for over a year for a bad cough and he never sent me to a specialist. Could I have a case?” So Bill is wondering if he should have been sent to a specialist.

Ed: Yeah, Bill, you could have a case. I will tell you, Molly handles a ton of medical malpractice cases at our office and does a really great job with it. I’m going to turn it over to her and let her tell you what you’re going to need to do to pursue a case like this. But, you definitely could have a case. What do you think he’s going to need to do?

Molly Clark: Yeah, I don’t think it would be an easy case. It sounds like it may be a little bit difficult to prove. But, the first thing you have to do is get your medical records. We have an in-house nurse, we can help with that, who would take a look at them and basically go through and see what your complaints are if your complaints were documents. And then, that way, you’ve been complaining and they missed some things or maybe they should have taken an x-ray or done some type of diagnostic studies. And they didn’t do that, then you may have a case. So it would really depend on what’s inside your medical records.
