I Was Pushed at a Baseball Game and Was Injured. Can I Sue?

A viewer was pushed by someone going for a foul ball at a baseball game, causing him to break his arm. He wants to know if he can sue. Personal injury lawyers Greg Fellerman and Ed Ciarimboli offer legal advice.

Dave Kuharchik: We got an incident at a baseball game topping this edition of “The Law & You.” Back with us tonight in the virtual law center attorneys Greg Fellerman and Ed Ciarimboli.

Ed Ciarimboli: I tell you this is a fascinating question.

Dave: It really is. It’s one we haven’t quite seen in a while at least. Let’s get to it. And it involves a scenario at a baseball game. Kevin says, “I was at a baseball game and got pushed by someone going for a foul ball and broke my arm.” Can Kevin sue them for that?

Ed: What do you think?

Dave: I’m going to say probably. It seems negligent by the other person.

Ed: Yeah so where do you think the potential money would come from?

Dave: It would probably have to be the facility.

Ed: No. Homeowners.

Dave: Really? Get out!

Ed: Yeah, so your homeowner’s policy, if you have one, has a clause in your homeowner’s policy that protects you if you are negligent. It’s personal coverage. So in a situation like this, the individual who pushed you, as long as they owned a home or even have a rental home, as long as they have coverage, it’s going to essentially have an umbrella policy in it that’s going to be able to protect them in this type of situation.

Greg Fellerman: Yeah and these homeowner’s policy comes into effect, and we see them in different cases. For example, an assault, believe it or not, a shooting, like a murder, we’ve been able to recover through a homeowner’s policy. If you have those types of cases, give us a call.
