Haley Bianco: It’s time once again for “The Law & You.” Joining us today from home, we have attorneys Greg Fellerman and Ed Ciarimboli. So nice to see you both!
Ed Ciarimboli: What’s up, Haley?
Haley: Hanging in there. Day by day. That’s all we can do right now.
Ed: That’s it!
Greg Fellerman: Yes.
Haley: That’s it! And get up to speed on legal things like this question today from Paul in Berwick. He’s asking, “I was walking around a national building supply store and a large box fell on me. I was taken to the hospital and I hurt my neck and back. I think I need neck surgery. What can I do?”
Ed: So, well, first of all, I hope you had your mask on! Number one. Uh, but we’ve actually handled a whole bunch of these cases. They’re called sky shelving cases and what happens is these big box stores, uh, in-instead of having a warehouse, they keep all the product in the store. And it’s really, you know, for profit. And so these sky shelves, they push so many materials up there, it becomes dangerous. And if they don’t stack – not only the stacking but then they don’t secure it the right way. They don’t strap it the right way and that’s – what ends up happening is this exact scenario. So we’ve had a number of these types of cases and we’ve been able to make great recoveries for people because there’s just a ton of policies and procedures and protocols that need to be followed so that this exact thing doesn’t happen.
Greg: Yeah, and we always say that you know, you walk into those big box building supply stores and they’re busy and they’re dangerous. I mean, they do take precautions. You know, they cord off the areas but there will be forklifts, equipment – a lot of things are going on and people get hurt in these stores all the time. So if you are, please make sure you fill out the incident reports, take pictures, uh document, go to the emergency room, get checked out, and then give us a call so we can, you know, protect the evidence that needs to be protected. But be careful when you’re in there, since they’re the only stores that are open too.
Haley: Yeah, absolutely. But if something does happen, you can always call Fellerman & Ciarimboli. They have their phones at home and they also are on the web. If you have more questions for “The Law & You”, go to PAHomepage.com
