Haley Blanco: It’s that time of the day for “The Law & You.” Joining us today at home we have attorneys Ed Ciarimboli and Greg Fellerman. Great to see you both.
Ed Ciarimboli: Haley, we can’t wait to be back in the studio with you!
Haley: We all feel the same way.
Greg Fellermn: At some point.
Haley: At some point, who knows when it will be, but in the meantime, you’re still able to be reached for calls on the internet so let’s get to today’s question in case this person wants to reach out to you further. Wayne says, “Is COVID testing covered by a group health plan?”
Ed: So Wayne, absolutely. One hundred percent it is covered, in fact, under the family first coronavirus response act, it now requires, requires, health plans to provide coverage for coronavirus testing that is FDA approved. There’s a lot of stuff out there that’s not FDA approved, that’s not going to be covered so it’s got to be FDA approved. Here’s the other thing. No deductible, co-pays, co-insurance. No precertification authorization is necessary in order to get that tested. So it’s really important, this is a great revision, but I’m going to kick to Greg and let him talk about, you know if you have an insurance company that’s trying to charge a deductible or co-pay, what you should be doing under these circumstances to protect yourself.
Greg: Yeah, well let me just say, usually we’re complaining a lot about how insurance companies don’t do the right thing, and legislatures don’t do the right thing. In this case, it looks like they actually have done it and they’re going to provide you with the coverage that you need right now with no co-pays etc. Which is what it should be, and if they don’t follow those, they’re going to subject themselves to penalties, etc. I don’t expect to see it but you never know because insurance companies have a tendency to not always do the right thing, but in this case, I think they have, and I commend everybody because this is a really scary time. So let’s see how this all plays out.
Ed: Yeah absolutely.
