A Man is Injured while Trying to Avoid Equipment Falling off a Truck

Dave Kuharchik: We’re talking today about gas drilling on this edition of the Law & You. Let’s get to attorneys Greg Fellerman and Ed Ciarimboli, guys thanks for being on a Friday.

Ed Ciarimboli: We’re ready to rule today, let’s go.

Dave: I know. You guys are all drinked up there, you’re ready to go. Here’s our question today and of course the gas drilling we’ve got a lot of issues with this and Henry in Bradford County has a question. He says, “I live in Bradford County in the area of gas drilling. I was driving behind a gas truck at a piece of equipment fell off the truck. I swerved to avoid hitting it and ran off the road and hit a tree. The guy did not stop. I have a broken a leg and a broken collarbone. What can I do?” Where does Henry start here?  Sounds like he has a possible case here.

Ed: Henry, you definitely have a possible case and here’s the problem that you’re gonna have. Right now, unless, you have some type of evidence to figure out who, what gas company this was then you’re not going to have a defendant in this particular case. You’re ultimately gonna have to resort to your own insurance policy and as we always talk about; this is gonna be in uninsured motorist case. And I’ll let Greg talk a little bit more about the specifics of what you’re gonna need to do but assuming you don’t have a license plate or a witness that’s what you’re gonna have to do on this.

Greg Fellerman: And also notify the State Police, notify your insurance company. And the other funny thing is with the piece of equipment falling off the truck, maybe there’s something on that piece of equipment that can help you identify the driver cause if that’s the case then you could sue the company and the driver directly. That’s probably the best but, again I don’t know we probably need a little more information, but that’s what I’d be looking at.

Dave: And that could be a saving grace and just getting you in the right direction.

Ed: No question.
