A viewer is worried his brother will go to jail after being arrested for a DUI and simple assault. Does he need a lawyer? Pennsylvania attorneys Greg Fellerman and Ed Ciarimboli explain what will happen next.
Dave Kuharchik: It’s time once again for the Law & You. We’re talking about a DUI incident today. Joining us as always is attorneys Greg Fellerman and Ed Ciarimboli. Welcome back, guys.
Ed Ciarimboli: Don’t drink and drive.
Dave: Good advice, yeah. All right, here’s the question. Tonight, we’ll see what we can do for one of our viewers and it involves a DUI situation. Klint in Bloomsburg says, “My brother got arrested for simple assault and DUI. He has a clean record by I’m worried he may go to jail. I am not sure if he needs a lawyer.”
Ed: Dave, what do you think?
Dave: I think getting a lawyer ASAP would be a good idea.
Ed: Yeah, Klint, you need a lawyer. You got simple assault and a DUI. Depending upon the circumstances of the assault and the DUI, whether they are two separate charges or whether they kind of stem from the same incident, you really need to get a lawyer on this because you could be staring at some potential jail time. You could be staring at some potential fines, probation, etc. Even with a clean record. I mean, really, depending on how severe the assault is.
Greg Fellerman: And it depends on the victim in that assault case and then the DUI. You didn’t really give us any information but you’re going to be losing your license, paying fines, paying court costs, supervision fees. And again, a lot of that might be able to be mitigated to some extent if you’re at the preliminary hearing with an attorney who knows what they’re doing to try to cut you the best deal you can. Obviously, acknowledging your guilt is important and if you get that part done, then hopefully the sentencing judge will accept that and get you moving on in your life. But this sounds like it was a really bad night if you have a simple assault and DUI.
Ed: I’m hoping that the simple assault didn’t happen contemporaneously with the DUI.
Greg: That could be bad.
Ed: That means the simple assault was either the police officer or somebody involved in the DUI. So yeah, not good.
