My Doctor Failed to Diagnose My Lung Cancer. What Can I Do?

A viewer believes his doctor failed to diagnose his lung cancer in a timely fashion. Is there something he can do? Medical malpractice lawyers Greg Fellerman and Ed Ciarimboli have the solution.

Dave Kuharchik: We got a question tonight about a lung cancer diagnosis. It is “The Law & You.” We’re back here in the virtual law center and the team is always the same. Attorneys Greg Fellerman and Ed Ciarimboli, always good to see you guys.

Ed Ciarimboli: Hey Dave, are we going to have a snowy winter?

Dave: I think it’s going to be a stormy winter.

Ed: Oh really?

Dave: Still need some time to see about the temperature but it’s been rough as of late. But legally tonight, we have a situation for one of our viewers who want to talk about it. Andy has been having some issues in Tannersville. He says, “I think my doctor failed to timely diagnose my lung cancer. I went to a specialist and he said he saw a small tumor two years earlier.” So Andy is wondering here, could something have been done by this doctor sooner?

Ed: Obviously, Andy, you went to the doctor, they did an x-ray and a radiologist had to read that scan. Let’s imagine that this piece of paper is your radiology scan and there was a tumor on there. If the tumor was on there and they missed it, then that’s going to be negligence. The problem with any cancer case is whether it would have made a difference. If it’s two years earlier and the size of the tumor is very small — if it was this big two years ago and now if it’s this big — then they could have taken it out and you would have had a higher percentage chance of survival. Especially long-term survival. Then you definitely have a very good case. Cancer cases are very complex in terms of the causation. And what I mean by causation is did the negligence an injury. And the injury here is could it have been caught earlier and if so, what could have been done differently. So, definitely need to get to a lawyer quickly on this.

Greg Fellerman: And in these situations, you really have to get to lawyers who handle them on a regular basis.
