A viewer’s gutter had broke and flooded her basement. She wonders if she should file an insurance claim. Insurance attorneys Greg Fellerman and Ed Ciarimboli explain what she should do next.
Dave Kuharchik: Seems like we’ve had rain for months on end and we’re going to address that today in this edition of “The Law & You.” It’s the virtual law center. Back with us tonight are attorneys Greg Fellerman and Ed Ciarimboli.

Ed: I tell you, people respond, “He’s so much happier.”
Dave: You know, Betty in Kingston, she’s not smiling. You know why? Because here’s what happened. “During one of the recent storms, my gutter broke and flooded by basement. Can I file an insurance claim?” What do you say to Betty?
Ed: Betty, the answer is yes. So, if your basement had just flooded because of too much groundwater, the answer would probably be no. But because there is a leak in the gutter and it broke, then your homeowner’s may cover it. Now, it’s going to depend on the specific provisions in your particular homeowner policy, but, I’m going to say that you have a good chance of filing a claim and being successful.
Greg: And file a claim and do yourself a favor and hire a public adjuster who can help you work on that claim. Because you’re going to be advocating against your insurance company to get coverage and these public adjusters, they do a great job of identifying the actual provisions in the insurance policy and they also help you get the right appraisal to submit or estimate to the insurance company to make sure you get paid everything you’re supposed to.
