My Insurance Company Denied My Business Interruption Claim. Why?

Haley Blanco: It’s time once again for “The Law & You.” Joining us once again from home are Attorneys Greg Fellerman and Ed Ciarimboli. Back for more legal fun. How are you guys?

Ed Ciarimboli: What’s up, Haley? Listen, I didn’t get a chance to get into hair and makeup today.

Haley: Well, that’s one of the things, the perks of being at home. You can get away with that.

Ed: Absolutely.

Greg Fellerman: He does that in November every year.

Haley: With that nice beard there. Nice and full. And full coverage from you guys in terms of legal cases. Let’s get to some of these questions. This comes from Jamie in Dallas. Jamie says, “I have business interruption insurance and my agent told me I don’t have coverage. I don’t get it. What can I do?” All right, so what do you guys think?

Ed: So, yeah, we’ve been hearing a lot about this and we’ve been taking a lot of calls about it. One of the biggest issues is that the agents are just telling people not to even file a claim, that they don’t have any coverage. And that is just patently false. You may or may not have coverage depending on the language in your policy. But the insurance company has absolutely an obligation to under the law to open a claim and investigate if whether there’s coverage. So you really got to force them to do it.

Greg: And we’ve actually done that. We’ve told clients to say, “That’s not an acceptable answer,” to call back. And we’ve actually seen where the insurance company opens a claim and closes it four hours later. So we think there could be some potential consequences for these insurance companies. So if you have a policy that has been denied or you have a question, give us a call because it’s really policy-based, like what’s contained in your policy. So give us a call and maybe we can help you with it.
