A viewer’s teenage son was arrested for underage drinking at a NASCAR race. What can happen to him? Attorneys Greg Fellerman and Ed Ciarimboli explain what happens next.
Dave Kuharchik: We’re talking underage drinking for this edition of “The Law & You.” Back with us tonight, attorneys Greg Fellerman and Ed Ciarimboli here in The Virtual Law Center. Good to see you guys today.
Ed Ciarimboli: I already feel it. This is not going to be a good set up.
Dave: You know this situation is not a good one. Let’s talk about this event at a NASCAR situation. Jessica in Berwick says, “My son was at a NASCAR race and he was arrested for underage drinking. He is only seventeen. What can happen to him?” Now, I know you guys don’t do criminal type law but what can you advise, gentlemen?
Ed: First of all, I love NASCAR. NASCAR events can get a little crazy. Your son getting arrested at a NASCAR event is not outside of the realm of possibility. First thing he’s going to need to do is get a lawyer because he’s going to be subjected to fines, his license’s going to be suspended. Hopefully this was his first and only time and he wasn’t a jerk to the people who arrested him so that ultimately he can get on ARD and I’m going to let Greg tell you about what ARD is. That’s going to be the ultimate goal here is get him on ARD.
Greg: Sometimes there’s diversionary programs at the district judge level that, with an underage drinking, they will work with you and with your son, put him in this program. If he completes some drug and alcohol counseling and doesn’t get into any other trouble, sometimes the judges will take care of the case at the district court level. That’s a good thing, it’s a great program. That’s why you need a lawyer, you could go and ask those types of questions.
Dave: I know you can someone up with a criminal lawyer that specializes in DUI situations.
Ed and Greg: Absolutely.
