My Store is Still Selling Recalled Dog Treats. Is It Responsible for a Dog’s Illness?

A viewer is concerned that a local grocery store is still selling recalled dog treats. Who is responsible if a pet gets ill after a customer purchased the recalled items?

Dave Kuharchik: We’re talking about dog treats tonight in this edition of “The Law & You.” Back with us tonight in the virtual law center are Attorneys Greg Fellerman and Ed Ciarimboli. Guys, good to see you tonight.

Ed Ciarimboli: We are animal lovers.

Dave: Good question tonight. We’ve heard some issues with pet food as of late and that’s where Kristen in Lock Haven is going. She says, “My hometown grocery store continued to sell recalled dog treats even after I provided them a printout of the notice. Whose responsibility is it if a pet gets ill after a customer unknowingly purchased the recalled items?” Good question, where does Kristen stand on this?

Ed: So, Kristen, you may have recourse not only to the grocery store because they’re selling the item after the recall, but you can file a claim or have a lawsuit against the manufacturer of the dog treats. Now again, depending on the nature of the injury to your dog, you’re not going to be able to get pain and suffering for your dog or something of that nature. All you’re going to be able to get is the amount of the veterinary bill if your dog does get sick. Because in Pennsylvania, we all love our pets but they are considered property.

Greg Fellerman: Nobody loves their pets than Ed. He has a whole host of chickens, dogs, cats, so he really knows a lot.

Ed: My wife just informed me we’re getting a guard guinea.

Greg: There you go, see?

Ed: I don’t know what it is but it’s a guinea hen so there.

Greg: Eddie loves pets. I have a cat so this was an interesting question.

Dave: And Ed’s got a farm. We’ve learned that much.
