Haley: They’re stuck at home, they have nothing else to do why not get free legal advice. Like this viewer who sent in this question. Andrew in Scranton, he is talking about immunity in nursing homes during COVID. “I see that the state is talking about immunity for nursing homes during COVID. My grandfather recently died in a nursing home and I think they were negligent. How is this fair?”
Ed: It’s not. It’s absolutely not fair. These nursing homes are corporations. So, there already are protections in place for nursing homes. Its the law. They would have to be negligent under the circumstances. So if the circumstances are that you have a virus that everybody knows can spread very easily and rapidly then you have to take reasonable precautions. You have to be reasonable under those set of circumstances. So if you just turn a blind eye to it then now, it’s not fair. They literally are getting away with murder at this point and its absolutely, absolutely not fair. Its another blow to the most vulnerable population.
Greg Fellerman: And the immunity concept is a tricky one because once you start throwing around the word immunity, most corporations will start to do as minimal as they have to. And now, if you say they’re immune from it, they’re not going to do anything. Ed and I talked about this over the weekend, the Legislature should caution themselves to who they are voting for when they put immunity in. They are voting against their constituents, the people who live in their districts, their parents and grandparents, that live in those nursing homes. We know you want to take care of those businesses but at the end of the day, you’re there to help your constituents and this won’t help them.
