A viewer’s sister died from an opioid overdose and she wants to know if she can sue the doctor. Personal injury lawyers Greg Fellerman and Ed Ciarimboli tell her what she can do next.
Dave Kuharchik: It’s time for “The Law & You,” talking opioid addiction today. We know that’s a big problem and the guys are here with the answer is Greg Fellerman and Ed Ciarimboli. Guys, Easter weekend is here.
Ed Ciarimboli: Yes, big weekend. You got any plans?
Dave: Spending some time with the family but always a good time to remind people to stay safe this weekend.
Ed: No question about it. Don’t drink and drive. Whatever you do, there’s Uber out there. Pick up the phone, call somebody. Because there will be checkpoints all over the place because it’s a long weekend.
Dave: All right, so we’ll get to the question now on opioids and here is the setup for Hailey in Scranton. Hailey says, “I see that you guys are involved in the opioid litigation. My sister died from an overdose. Can I sue the doctor that gave it to her?” What can you say about that?
Ed: Hailey, first of all, we’re very sorry to hear about your sister. Unfortunately, 150 people a day are dying from opioid addiction. It truly is an epidemic. Can you go after the doctor who overprescribed it? Yes, you can. We’ve had a number of cases, we have cases we’re looking at right now involving this. So, the thing you need to do is not only get the medical records of your sister, you need to find out all of the pharmacies that she was going to get these prescriptions filled. Because it’s going to create a paper trail, and that paper trail is going to become the real backbone of any type of malpractice case against the doctor.
Greg Fellerman: The other thing we’re doing is we’re doing the cases against the manufacturers and distributors. There’s municipalities, there’s government agencies that we’re representing. So, there’s a lot of recovery out there because we’re seeing that it looks as if there was a lot of manipulation by the manufacturers and distributors on these cases. A very unfortunate epidemic that has hit this area extremely hard. Very, very hard in this area. We’ve been busy with that stuff.
Dave: And I know that people out there, you can point them in the right direction. The phone number, the website is on the bottom of the screen. And don’t forget results matter. Attorneys Greg Fellerman and Ed Ciarimboli, have a good weekend.
Ed: Thanks, Dave.
