Property Owner is Pressing Charges Against ATV Rider for Trespassing.

A viewer’s son was riding on the back of a friend’s ATV through private property. The owner is now pressing charges for the trespassing incident. Is the son in trouble? Attorneys Greg Fellerman and Ed Ciarimboli explain what will happen next.

Dave Kuharchik: It’s time again for “The Law & You.” An ATV, that is the subject of today’s question. Attorneys Greg Fellerman and Ed Ciarimboli from Kingston. Guys, good to see you.

Greg Fellerman: Thanks for having us Dave.

Dave: Let’s get to the question here about the ATV, “Our son was riding on the back of his friend’s ATV. Now we find out they were trespassing on private property and the owner is pressing charges. Is our son in trouble?”

Greg: The answer is probably yes, because both the driver and your son being a passenger were on someone else’s land. If the land has been properly posted and they disregarded those signs and drive their ATV onto this landowners property, the land owner has every right to press charges against the operator and your son who’s the passenger.

Ed Ciarimboli: Make sure that, if your son is going ATV riding -I mean a lot of people do, it’s the summer months. Everyone wants to be outside, they want to be active, which is fine- get permission. If it’s not your land, get permission to ride on the land. The property owner has every right to keep you off their land, and for good reason. ATVs are dangerous. If somebody gets hurt on somebody else’s property, there could be a lot of pitfalls with those things. If your going to go riding, make sure that they have permission; If they don’t, then you better get them a good criminal defense lawyer because there could be some pretty serious lines and charges.
