The Law and You

Seriously Injured at Work | Unfamiliar with Machine | Employee Shortage

Haley Blanco: It’s that time of the day for “The Law & You.” Joining us today from home we have attorneys Greg Fellerman and Ed Ciarimboli. So great to see you both. How are you and your families coping through all this?

Ed Ciarimboli: Everybody’s doing okay. How about you? How are the dogs?

Haley: Day-to-day, you know. They like when I’m working from home. And I think they also like when I’m at work because it gives them a little break. (laughs) Well, we’re all stuck at home, still helping out our viewers with legal questions. So, let’s get to today. This comes from Howard in Hanover, Twp. He says, “My friend was seriously injured at work at a factory and was unfamiliar with the machine because of a shortage of employees. What can he do?”

Ed: So, you know, here’s the thing that everybody has to realize, just because we’re in very unprecedented times, the workers’ compensation laws haven’t changed, personal injury laws haven’t changed, so all the things that we would normally advise people when there was not a crisis they’re even more important now. The things that you have to do to protect yourself–make sure you file a claim, make notice of the claim, and in addition to that, if it’s a machine, you have to do an inspection of the machine in order to see what’s going on with the machine. You might not be able to do that right now but you have to get letters out to preserve that evidence because in cases like this, if you don’t, you may not have a case in a couple of months so, you really have an obligation to do that stuff. So pick up the phone and give us a call.

Greg Fellerman: We’ve done a couple of inspections early on in the COVID crisis in our trucking cases so I think it can still be done. Obviously you have issues with medical, medical care so if you have these types of cases, you have to pick up the phone and give us a call, we can get you online and help you through it and get those letters out to preserve that evidence will be really crucial.

Ed: Yes, absolutely.

Haley: Alright, thanks guys, great advice today. Thanks for your time. We’ll see you next time. If you have questions for the Law and You, go to
