Sister Was in Tractor Trailer Crash | Boss Telling Her to Go Back to Work

Haley Blanco: It’s now that time of day where we give you free legal advice. Joining us once again from how we have attorneys Ed Ciarimboli and Greg Fellerman. So nice to see your friendly faces today.

Ed Ciarimboli: What’s up, Haley? How’s the dogs doing?

Haley: They love when I’m home, they are enjoying the TV spotlight.

Ed: Cool!

Haley: They’re getting on more than ever, playing around so they’re loving and our viewers are loving being able to see you from home, and they’re asking questions like Bill in Dupont. He’s asking, “My sister was in a tractor trailer crash a couple of months ago while she was working. Her employer was paying her but now is telling her to go back to work. She had a concussion and a broken leg. Does she have to go back to work and can she sue the tractor trailer driver?”

Ed: She does not have to go back to work, and it sounds like she’s past the period where she has to treat with the workers’ compensation doctor. So, she really needs to get to a doctor that’s looking out for her rights not the employer’s rights. And then secondly yes she can absolutely sue the tractor trailer company. Even though she was in the course in the scope of her employment, she has workers’ compensation claim, which is going to pay her wages and her medical bills, and then she’s going to have what’s called a third party claim against the operator of the tractor trailer and his or her company for causing this particular reck and those injuries.

Greg Fellerman: And actually with this type of case your employee actually benefits because their workers compensation will be paid back in full once the third party case resolves because they’re going to be forced to pay those medical bills that workers’ compensation paid.
