I Think the Tractor-Trailer Driver is Lying About the Cause of Our Accident. How Can I Prove it?

Ed Ciarimboli: Dave, I’m going to put you on the spot. Are we done with the nor’easters?
Dave: I think we can still see some snow. I hate to tell you that.
Ed: It’s ridiculous. This is enough.
Dave: We’re paying for that warm stretch in February now. Here we go with our question tonight and this involves a tractor-trailer accident. Mike from Hamlin says, “I was hit by a tractor-trailer driver in upstate PA. I am sure he is not telling the truth about what happened. Is there any way to prove he was going too fast or was fatigued?”
Ed: You know, Mike, there are many ways that you can prove that he was going too fast or fatigued. You can do a download of the driver’s ECM module which is going to show you the speed up until the time of impact. You get his log books. You can compare the log books with fuel receipts and toll receipts. That’s going to show you if he’s being truthful on his logs or driving over the hours of service. There’s a whole number of things you can do but the most important thing you need to do, you need to get to a lawyer fast. Because if you don’t, you’re not going to be able to prove any of this.
Greg Fellerman: Yeah, we’ve had cases where we’ve actually recreated the driver’s routes and basically disproved their theory that they were operating within hours, that they weren’t speeding. We were able to prove all that because they have all those electronic records. They use to have two sets of books, now we just get them with the electronics and it works pretty well.
