A couple involved in a tractor-trailer accident says the trucking company is denying liability after driver causes an accident while making a U-turn. Dave: Yeah, we have a picture today, it’s going to be a big question. All right, let’s set it up first here with the question itself. We’re talking to Bill in Jenkins Township. Bill says, “My wife and I were involved with a tractor-trailer doing a u-turn. My wife has very serious injuries. We just got a letter from the trucking company saying they are denying liability. What can we do?”
So picture with this, we’ll take a look set it up and Ed, what are we looking at?
Ed: What you’re looking at is the tractor-trailer is obviously doing a U-turn and we’ve litigated a number of these cases. And what I will tell you is that we have manuals from trucking companies all over the country. A good trucking company instructs its drivers to never to a U-turn. Ever. They are one of the most dangerous maneuvers that a tractor-trailer driver can make. There is a ton of science that’s behind it in terms of how long it takes a tractor-trailer to actually make the U-turn but we have been successful in litigating these cases. So the fact that the trucking company is denying liability, you absolutely should give us a call. Especially if your wife has serious injuries. We can help you out in this.
Greg Fellerman: Well, the thing is with these U-Turn type of cases, there’s a lot of work that needs to be done as soon as possible. The good news is there are some pictures here. Reconstructionists need to start working on that and experts need to be retained to figure out what went wrong. Because at the end of the day, the tractor-trailer in these situations — we’ve had them all over Northeastern Pennsylvania — in these type of cases, what they should do is pull over, get on the cell phone, call the state police, call their own company, and figure out a way to turn that vehicle around safely. And they don’t do it. And that’s where the problem ends.
Dave: And a picture like that is critical in a case like this, isn’t it? It really helps create a more clear picture.
Ed: No question about it. The picture is a key, key, key piece of evidence in the case because it’s going to document exactly what happened that particular day. So very, very, very key piece of evidence.
