A viewer is upset after getting into an accident with a tractor-trailer trying to make an illegal U-turn. The viewer was severely injured yet received a citation for driving too fast. Was she at fault for the accident? U-turn truck accident lawyers Greg Fellerman and Ed Ciarimboli set the record straight.

Dave: Absolutely! I’ve noticed the socks, Ed.
Ed: Well, you know, my daughters pick out some colorful one’s for me.
Dave: It’s spring time, why not. Let’s get to our question today. This one’s in from Lindsey in Bloomsburg. She says, “I was driving down the road when a tractor trailer did an illegal U-Turn in front of me. I couldn’t stop and we collided. I have severe neck and back pain and mt car was totaled. I received a ticket for driving too fast for conditions. I wasn’t at fault and I can’t believe I was cited. What can I do?” It sounds like Lindsey is saying one thing and law enforcement is saying another.
Ed: Lindsey you got a lot going on. First and foremost, in this particular type of situation, rest assured that the trucking company is going to be out there doing a full investigation. You need to get to a lawyer that handles tractor-trailer accidents; You need somebody on your side that’s going to be able to do the same and prove that you weren’t traveling too fast for the conditions, to show that the truck driver was, in fact, at fault, and put together a case from the standpoint of the injuries that you have. Make sure you get the compensation you need and deserve. We’ve handled a number of u-turn cases, they’re not easy cases. I’ll let Greg talk about it a little bit more. You certainly need to get to a lawyer.
Greg Fellerman: The u-turn cases are interesting because we handled a very difficult one a few years ago; It had a great result, and Ed spoke about it nationally. If you have questions on those types of cases, you need to get to the lawyer and get the answers you need. At the end of the day, tractor-trailers should not be making u-turns on any road in the Commonwealth of Pennsylvania without the assistance of law enforcement; It’s that simple. Even though you might have been driving fast, they shouldn’t be doing that illegal turn; You probably have a case so you should definitely talk to a lawyer.
Dave: Sounds very complicated.
Greg: They are very complicated. The truth is truck companies know it, truck drivers know it, and their safety directors know it; They’re not supposed to make those turns. We’ve proven that.
Ed: There are specific rules and regulations in place from an industry standpoint and a legal standpoint; Whether you’re in Pennsylvania or any other states there are specific rules regarding u-turns.
