Updates In Hernia Mesh Lawsuits

According to the U.S. Food and Drug Administration, more than one million hernia repairs are performed each year in the U.S. For many, hernias are caused by a combination of pressure and weakened muscle or connective tissue. It can occur at birth but more often occurs later in life. Because there are few treatment options, most seek surgery for repair.

However, many of the implants performed use untested mesh resulting in injury. In many cases, the mesh isn’t even tested on a single human before being used in surgery.

This isn’t just a United States issue, it’s happening everywhere. According to a BBC report, “more than 100 different types of mesh were purchased by NHS Trusts from 2012 to 2018 in England and Scotland, leading to fears over safety.”

In December 2019, the number of hernia mesh continued to rise across the U.S. According to Drug Watch, “The combined number of pending cases had more than doubled during the first eight months of 2019, from 2,954 lawsuits in January to 6,818 lawsuits in August. The multidistrict litigations  grew another 13 percent by November 2019, reaching a combined 7,711 lawsuits.”

Multiple companies have been targeted including Atrium C-QUR Mesh, Ethicon Physiomesh Flexible Composite Mesh and polypropylene hernia mesh made by Bard Davol.

It’s important to know that when you have been a victim of medical malpractice due to a hernia mesh implant, you only have two years from the date of the surgery, or the harm, in this case, to file a lawsuit.

Pelvic Mesh Banned While Hernia Mesh Still Utilized By Medical Professionals

In April 2019, The U.S. Food and Drug Administration banned manufacturers from creating all remaining surgical mesh products indicated for the transvaginal repair of pelvic organ prolapse. However, it still continues to be used for hernia repairs despite the similarities of patient complications.
